Terms and Conditions

These General Terms and Conditions of Purchase govern the use of the website Nunet-design.com (hereinafter “the Website”), which is owned by Nunet Design, s.l.l. (hereinafter “Nunet”). Nunet Design, s.l.l. is a limited liability company, with its registered office at Calle Estocolmo, 12, 28840 Madrid, Spain, with Tax Identification Number (NIF) B72928823, and registered in the Madrid Commercial Register, M-789177, Volume 44826, Folio 1, Section 8. The customer’s use of the online shop’s services implies, in all cases, acceptance of the General Terms and Conditions of Purchase in the version published at the time of the purchase order. Therefore, it is advisable for the customer to read these General Terms and Conditions before proceeding to make a purchase.

1. SCOPE OF THE CONTRACT.

These General Terms and Conditions of Purchase apply to the sale of all Nunet items via its website. Nunet hereby states that its website is intended exclusively for persons aged 18 and over. Nunet reserves the right to cancel a customer’s account if fraudulent, speculative or bad-faith conduct is detected in the use of this service.

2. PURCHASE LIMIT.
For security reasons, purchases exceeding €10,000 or containing more than 50 items per order cannot be made.
3. PRICE.
The applicable prices are those indicated on the website on the date of the order. Prices are listed in detail for each item and include VAT (Value Added Tax) in all countries as applicable. The amount of the delivery charges is shown to the customer in a breakdown at the time the order is placed.
4. PAYMENT.
Payment must be made upon completion of the purchase process and is an essential condition for the transaction to be finalised. Under no circumstances may payment be made at a later date. Payment via deferred methods, such as cash on delivery, is not accepted. Accepted payment methods: Purchases can be paid for by Visa® or Mastercard® credit card. In any case, the choice of payment method is made during the purchase process on the relevant screen.
The customer must notify Nunet of any unauthorised or fraudulent charges on the card used for purchases, by email or telephone, as soon as possible so that the necessary steps can be taken. Payment providers or issuers may implement
anti-fraud measures that result in the rejection of certain types of transactions. Nunet is not responsible for the application of such security policies.

5. DELIVERY.
Orders will be delivered to the address provided by the customer, subject to the following conditions:
• For deliveries within Spain, the estimated delivery time is 1 to 6 working days.
• We do not operate at weekends or on public holidays, so if the delivery date falls on a Saturday or Sunday, there will be a delay of 2 extra days.
• The delivery time for personalised products is 1 to 2 weeks.
5.1 Home delivery:
Standard delivery: The customer must pay the delivery charges: €6 within Spain, €15 within Europe and €30 to all other countries. Nunet covers all taxes.
The address provided by the customer may be a home address, a workplace or any other address specified. The billing address and delivery address do not need to be the same. Our delivery partner will send an email or SMS (if you have provided a mobile number in your order) indicating the day of delivery and allowing you to change the delivery date. On the day delivery is scheduled, our delivery partner
will send an email or SMS (if you have provided a mobile number in your order) informing you of the approximate delivery time slot.

5.2 Delivery issues:
If delivery cannot be made because the recipient is absent, the courier will leave a note and attempt to contact
the recipient by telephone. After two unsuccessful attempts, the customer must contact the courier to arrange delivery.

6. EXCHANGES, RETURNS AND CANCELLATIONS.
There are different procedures for making exchanges, returns and cancellations. Below, we describe the characteristics of each, as well as their costs and conditions.
1. Exchange: an exchange is defined as the replacement of an item with the same product in a different colour and/or size.
2. Return: in the event of a fault or defect.
3. Cancellation: at the customer’s discretion.
4. Personalised items:
As these are personalised garments, it will not be possible to exchange or return them, and purchases of personalised items cannot be cancelled.
Delivery times for personalised products will be between 6–10 days from the date of purchase.
Important: All products purchased as personalised items cannot be exchanged or returned.
All products to be exchanged or returned must be properly packaged.
In the event of withdrawal, you will only be liable for any reduction in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

6.1 TERMS, REFUNDS AND PROCEDURE.
Terms (Exchanges and Cancellation): You have 60 calendar days from receipt of the product(s) to cancel the contract without giving any reason. We do not offer exchanges as such, so you will need to return the item and place a new order for the new product.
Terms (Returns): Nunet shall be liable for any lack of conformity that
becomes apparent within the period established by law.
Refund: Nunet shall refund, where applicable, the corresponding amount without undue delay and, in any event, within 14 calendar days of being informed of the return. The refund will be made via the same payment method used for the purchase. However, we may withhold the refund until we have received the goods, or until you have provided proof of the return of the goods, whichever occurs first.

Items purchased online cannot be returned in-store.

7. PRODUCT AVAILABILITY.
If there are any issues with supply or if products are out of stock, the customer will be informed immediately and a refund will be issued for the cost of the out-of-stock product(s). Nunet will refund the corresponding amount without undue delay and, in any event, within 14 calendar days. The refund will be made via the same payment method
used for the purchase. The stock availability details for our physical store shown on our website are for guidance only and may vary.
8. WARRANTY FOR PURCHASED PRODUCTS.
The warranty offered is that established in Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users.

9. CUSTOMER SERVICE.

Nunet’s Customer Service team will address and respond to your complaint as soon as possible, and in any event within a maximum period of one month. Should your request not be resolved satisfactorily, you may take the matter to the ordinary courts or submit your complaint via the website http://ec.europa.eu/odr, which provides a free single point of access for out-of-court resolution.
10. AMENDMENT OF THE GENERAL TERMS AND CONDITIONS OF PURCHASE.
Nunet reserves the right to amend these General Terms and Conditions of Purchase at any time. No amendment shall affect orders that are already in progress.

11. FORCE MAJEURE.
Nunet’s performance of all or part of its obligations shall be suspended in the event of an unforeseeable circumstance or force majeure that prevents or delays such performance. The following shall be considered as such, in particular, without this list being exhaustive: war, riots, insurrection, social unrest, strikes of any kind and supply issues not attributable to Nunet. Nunet shall inform the customer of such an unforeseeable event or force
majeure within seven days of its occurrence. Should such a suspension extend beyond a period of fifteen days, the customer shall then have the option to cancel the current order, and a refund shall be issued in accordance with the conditions set out in clause 6 of these General Terms and Conditions of Purchase.
12. GOVERNING LAW AND JURISDICTION.
These General Terms and Conditions of Purchase are governed by Spanish law. Notwithstanding the foregoing, consumers not resident in Spain shall also enjoy the protection afforded by the mandatory provisions of the law of the country in which they have their habitual residence. The parties hereby submit, at their discretion, to the courts and tribunals of the customer’s place of residence for the resolution of any disputes, waiving any other jurisdiction.
